1. DEFINITIONS
The terms and expressions listed below shall have the meanings indicated hereunder, with the understanding that terms defined in the singular shall also apply in the plural and vice versa:
Customer: refers to any individual or legal entity that purchases one or more Products through the Online Store, accepting the General Terms and Conditions.
SUNO Srl: refers to SUNO Srl, a company with its legal headquarters in Belluno, Via Sottocastello, 22.
Parties: refers jointly to SUNO Srl and the Customers.
General Terms and Conditions: refers to these General Terms and Conditions of Sale and any future versions that may be published in the Online Store by SUNO Srl.
Online Store: refers to the virtual store, managed by SUNO Srl and accessible via the URL www.sunosport.com, through which Products can be purchased.
Sales Contracts: refers to the sales contracts of Products concluded, as per Article 3, between SUNO Srl and Customers through the Online Store.
Orders: refers to the purchase orders for Products submitted by Customers, in accordance with the General Terms and Conditions and following the procedure outlined in Article 6.
Order Confirmation: refers to the email message through which SUNO Srl informs Customers of the acceptance of their Orders.
Price: refers to the sale price of the Products as indicated in the Online Store next to the respective Products.
Products: refers to the products published in the Online Store for sale purposes.
Profile: refers to the area of the Online Store where Customers can, after authentication:
I. View and modify their personal data and the addresses where Products from Orders will be shipped and delivered;
II. View previous Orders;
III. Update privacy preferences;
IV. Access any other specific function related to their activity in the Online Store.
Account: refers to the area of the Online Store where Customers can after authentication:
I. View and modify their personal data and addresses where Products from Orders should be shipped and delivered;
II. View previous Orders;
III. Update privacy preferences;
IV. Access any other specific function related to their activity in the Online Store.
Guest User: refers to a user who accesses the area of the Online Store without prior registration and authentication, solely for the purpose of completing a single purchase order. In this case:
Personal data and addresses where Products from Orders are to be shipped and delivered will not be saved; II. It will not be possible to view previous Orders or access any other specific function related to the activity in the Online Store.
2. SUBJECT
2.1 These General Terms and Conditions govern all Sales Contracts and form an integral part thereof.
2.2 SUNO Srl reserves the right to modify the General Terms and Conditions at any time; however, the version in effect at the time the Order is placed by the Customer, as published on the Online Store, shall apply to the relevant Sales Contract.
2.3 In the event of any conflict between these General Terms and Conditions and any other terms and conditions relating to the Sales Contracts published on the Online Store, the terms and conditions most favourable to the Customer shall apply.
3. CONCLUSION OF SALES CONTRACTS
3.1 SUNO Srl shall send the Order Confirmation to the Customers within 2 working days of receipt of the Customer’s Order.
3.2 The Sales Contracts shall be deemed concluded between the Parties when the Customers receive the Order Confirmation. If the Customers do not receive the Order Confirmation within the timeframe specified in Article 3.1, the relevant Order shall be considered rejected by SUNO Srl and thus null and void.
3.3 By submitting the Orders, the Customers declare that they have reviewed all instructions related to the purchasing process of the Products as defined in Article 6 as well as all additional information available on the Online Store, including information referenced via links, and that they accept in full the General Terms and Conditions.
3.4 The Orders shall be stored in the Online Store’s database, in compliance with the provisions and methods of the applicable Privacy Regulations, and shall be accessible by contacting SUNO Srl at the contact details provided in Article 16. Orders shall also be accessible by logging into the Customer's account profile.
4. PRODUCT AVAILABILITY
4.1 Except as provided in Article 4.3, for each Product listed on the Online Store, SUNO Srl shall indicate whether the Product: I. Is available in its warehouses; II. Is not available in its warehouses.
4.2 The types of Products listed on the Online Store and their availability may change at any time without this entailing any liability for SUNO Srl towards the Customers.
4.3 In the event of subsequent unavailability of a Product listed as available at the time the Order was placed by a Customer, SUNO Srl, subject to the provisions of Article 3.2, undertakes to inform the Customer, in a subsequent communication via email, of the estimated timeframes for possible future availability of the Product(s) subject to the Customer's Order, or to proceed with a refund for the unavailable Product.
4.4 SUNO Srl reserves the right not to indicate the availability of some or all of the Products listed on the Online Store.
5. PRICE AND SHIPPING COSTS; TAXES AND DUTIES
5.1 The applicable Price shall be the one published on the Online Store in the currency of the Customer’s country of reference at the time of Order submission.
5.2 The Price is inclusive of VAT (if the Products are shipped by SUNO Srl and delivered within the European Union).
5.3 The Price does not include shipping costs. SUNO Srl reserves the right to charge Customers a contribution for shipping costs, which may vary depending on the type of delivery, the quantity of Products to be delivered, their volume, weight, and destination.
5.4 The contribution charged by SUNO Srl for shipping costs shall be indicated separately from the Price, prior to the submission of the Order by the Customers, and shall be paid by the Customers concurrently with the Price, in accordance with the payment methods specified in Article 7.
5.5 Any taxes, duties, customs fees, or other charges imposed under the laws of the country of destination shall be fully borne by the Customers and paid by them at the time of delivery, either directly to the relevant tax or customs authorities or to the carrier responsible for delivery.
6. ORDER SUBMISSION METHODS
6.1 In order to proceed with submitting Orders, Customers are required to register on the Online Store by providing all "mandatory" information and creating a password to enable Orders submission and access their profile, even at a later time. Alternatively, Customers may proceed as a "Guest" user by providing only the necessary information for payment and delivery.
6.2 Customers may purchase Products by selecting them from the section of the Online Store dedicated to the type of Product being searched for and adding them to the "cart." If the Products the Customers wish to purchase exceed one, the same procedure mentioned above must be repeated. Once the selection of Products is complete, Customers must, if not already done previously, proceed with the registration as outlined in Article 6.1 or, if already registered, authenticate by entering their email address and password in the appropriate fields and clicking on "Proceed to checkout." After verifying the accuracy of the details regarding the selected Product(s) and the "shipping information," Customers must choose a payment method as described in Article 7. Once the payment method is selected, Customers may proceed with submitting the Order by clicking on "Confirm Order."
7. PAYMENT METHODS
7.1 Customers may pay the Price and the contribution for shipping costs outlined in Article 5 using a credit card, PayPal, or other payment methods that may be specified by SUNO Srl on the Online Store. SUNO Srl reserves the right to modify, at any time, the available payment methods for Customers, provided that only the payment methods published on the Online Store at the time the Orders are placed by the Customers shall be deemed applicable.
7.2 For credit card payments, the charge for the Price and the contribution for shipping costs as outlined in Article 5 will occur simultaneously when the Order Confirmation is sent by SUNO Srl. The credit card details provided during the Order process are protected and managed through the Shopify platform; therefore, SUNO Srl does not have access to any information regarding the credit card used.
7.3 For PayPal payments, at the time the Orders are submitted by the Customers, the web session will be redirected to PayPal’s secure website. On this website, Customers may complete the payment for the Price and the contribution for shipping costs as outlined in Article 5 using their PayPal account, in accordance with the terms of use of the PayPal service that the Customers have agreed to at that time or previously. The charge for the Price and the contribution for shipping costs referred to in Article 5 to the Customers' PayPal account will occur simultaneously when the Order Confirmation is sent by SUNO Srl.
7.4 If requested by the Customers when providing billing information, SUNO Srl will issue a regular invoice to the Customers at the time the Orders are submitted. For individuals, the invoice can be sent either via email or by regular mail. For the purposes of issuing the invoice, the information provided by the Customers shall be deemed accurate. No changes to the invoice will be possible once it has been issued by SUNO Srl.
7.5 The information received by SUNO Srl pursuant to this Article 7 will be used exclusively to complete the processes related to the sale of the Products and for refund processes in the event the Customers exercise their right of withdrawal as outlined in Article 9.
8. SHIPPING AND DELIVERY OF PRODUCTS
8.1 For the purposes of these Terms, "shipment" of Products by SUNO Srl means the handover of Products to the couriers selected in accordance with Article 8.2. SUNO Srl is not obligated to ship Products until full payment of the Price has been received. Once payment is confirmed, SUNO Srl undertakes to ship the Products as follows:
I. For Products in stock (as defined in Article 4)
- Within 3 working days of receiving the debit authorization notification under Article 7.2 (for credit card payments);
- Within 3 working days of SUNO Srl being notified of payment completion (for non-credit card payment methods).
II. For Products whose availability is not indicated (as per Article 4.3) but which are in stock at SUNO Srl's warehouses when the Order is placed:
- Within 3 working days of receiving the debit authorization notification under Article 7.2 (for credit card payments);
- Within 3 working days of SUNO Srl being notified of payment completion (for non-credit card payment methods)
8.2 Delivery may be made within the territory of the country associated with the the Store where the user is browsing at the time the purchase process begins. The user is therefore required to provide a shipping address within the borders of the country associated with the Store in the order form.
"Store" refers to the selection to be made in the menu at the top right:
-Store IT: Italy
- Store EN: Rest of the world
Shipping is only available to the countries listed below, which can be selected from the drop-down menu during the checkout process:
- IT: Italy
- EUROPE: Austria, Belgium, Denmark, Estonia, France, Germany, Latvia, Lithuania, Netherlands, Poland, Portugal, Czech Republic, Romania, Slovakia, Slovenia, Spain, Hungary, Greece, Luxemburg, Sweden, Bulgaria, Malta, Croatia, Finland.
Shipping is not available to the following countries: Vatican City, Republic of San Marino, and all other countries not mentioned in the lists above.
Shipping is not available to the following locations: Campione d'Italia, Livigno, Ceuta and Melilla, the Canary Islands, Heligoland, the Isle of Man, the Channel Islands, the Austrian territories of Jungholz and Mittleberg, the Musingen Territory.
Orders that include a shipping address outside of these boundaries will be cancelled, and the total amount due will be refunded, if already paid.
8.3 SUNO Srl is committed to ensuring that the Products shipped pursuant to Articles 8.1 and 8.2 are delivered by the selected couriers:
- In Italy, within 4/5 days from the shipping date;
- Outside of Italy, within 5/9 days from the shipping date.
8.4 The delivery terms specified in Article 8.3 cannot, in any case, be considered binding. Since SUNO Srl cannot directly control the delivery of Products after they have been shipped, it cannot be held responsible in any way for any failure to meet these terms.
8.5 In order to allow Customers to track the status of their Orders, SUNO Srl will generate an Order number, which, when entered in the "My Orders" section — accessible from all pages of the Online Store — will enable Customers to view all information related to their Orders.
8.6 Customers can also check the status of their Orders using the "Order Tracking" online function provided by SUNO Srl’s chosen courier. This tracking can only be accessed by the Customers after the Products have been shipped,and using the tracking details provided by SUNO Srl via email or by accessing their Profile.
8.7 Upon delivery, the Customers, or other individuals designated by the Customers at the delivery address specified in the Order Confirmation, are required to verify that:
I. The Products match those listed on the courier's delivery note, both in terms of quantity and type;
II. The packaging of the Products is intact, undamaged, not wet, or otherwise altered, including the sealing materials.
8.8 Any damage to the packaging of the Products must be immediately reported by the Customers by endorsing a written inspection reservation on the courier's proof of delivery. It is hereby agreed that once the courier's document is signed without any objections, the Customers shall no longer be entitled to raise any claims against SUNO Srl regarding the external condition of the delivered items.
8.9 Products can only be delivered by the couriers to the Customers or to individuals authorized by them; the person to whom the Products are delivered must sign to acknowledge receipt of the delivery. Couriers do not deliver to P.O. boxes or by placing Products in mailboxes or similar locations.
8.10 Shipping within Italy: free shipping for orders of €39 or more. For orders below this amount, a shipping fee of €2,90 will apply.
8.11 Shipping outside Italy: free shipping for orders of €59 or more. For orders below this amount, a variable cost applies based on the country of origin (see table below).
EUROPE 1:
Austria, Belgium, Denmark, Estonia, France, Germany, Latvia, Lithuania, Netherlands, Poland, Portugal, Czech Republic, Romania, Slovakia, Slovenia, Spain, Hungary.
Shipping cost: 7,90€
EUROPE 2:
Greece, Luxemburg, Sweden, Bulgaria, Malta, Croatia, Finland.
Shipping cost: 12,90€
9. RIGHT OF WITHDRAWAL
9.1 Customers have the right to withdraw from the Sales Contracts within 15 days from the date of receipt of the Products subject to the Sales Contracts. The right of withdrawal must be exercised by the Customers by sending a written communication to SUNO Srl via email at the address support@sunosport.com, as specified in Article 16, containing:
I. A statement of the intention to exercise the right of withdrawal;
II. The details of the Order that gave rise to the Sales Contract from which they wish to withdraw.
9.2 In the event that the Customers exercise the right of withdrawal under this Article 9:
I. The Customers agree to return the Products within 10 working days from the date of the withdrawal notice referred to in Article 9.1;
II. All costs associated with the return of the Products shall be borne solely by the Customer;
III. SUNO Srl undertakes to refund the Price as soon as possible, and in any event no later than 30 days from receipt of the withdrawal notification referred to in Article 9.1, provided that:
- The Products have been returned in their original, unused condition;
- The original packaging of the Products has also been returned and is intact;
- Any accessories, instruction manuals, etc., have also been returned and are intact;
- The Products have not been used.
IV. The refund will always be issued using the same payment method used for the purchase.
9.3 If the Customers exercise the right of withdrawal in a manner that does not comply with the methods and terms set forth in this Article 9, the Customers will not be entitled to a refund of the Price.
10. DEFECTS / NON-CONFORMITIES OF PRODUCTS
10.1 Any defects/non-conformities must be reported by the Customers directly to SUNO Srl via email at the address support@sunosport.com.
10.2 Customers may request from the seller, within the term specified in Article 132 of Legislative Decree 206/05 (Consumer Code), the remedies provided under the same Consumer Code for any lack of conformity existing at the time of delivery of the Products.
11. PRODUCT LIABILITY
The manufacturer of the Products is responsible for any damage caused by defects in the Products.

13. ERRORS AND/OR INACCURACIES IN THE ONLINE STORE
13.1 SUNO Srl undertakes to regularly check the Online Store to prevent errors or inaccuracies. However, it is possible that the Online Store may contain, or may in the future contain, errors, inaccuracies, or omissions.
13.2 Therefore, SUNO Srl reserves the right to correct any errors, inaccuracies, or omissions in the Online Store, even after an Order has been submitted. SUNO srl further reserves the right to change or update the information at any time, without prior notice to the Customers.
14. INTELLECTUAL PROPERTY
All intellectual property rights related to the Online Store (including its content) are the exclusive property of SUNO Srl; the Online Store and its contents may not be reproduced, either in whole or in part, nor transferred by electronic or conventional means, modified, linked to, or used for any purpose without the prior written consent of SUNO Srl.
15. GOVERNING LAW
15.1 The General Terms and Conditions and the Sales Contracts are governed by Italian law.
15.2 For any dispute that may arise in connection with the General Terms and Conditions and/or the Sales Contracts, the exclusive jurisdiction shall lie with the Court of Belluno.
